Three years on, Jacinda’s Legacy of Control lingers on!
If you thought the days of COVID were completely dead and gone...you’re wrong!
This Monday, November 4th 2024, Brian Tamaki heads to court for a ten-day trial, facing COVID charges against him from the NZ Police.
Who could forget when the police held Brian in solitary confinement for ten days at Mt. Eden Prison, followed by a 24/7 home curfew for another 67 days—all because he dared to speak out publicly?
With the police's history of targeting Brian and their persistent refusal to drop the charges, he's gearing up for a tough court battle ahead.
Is this Police blackmail?
In recent weeks, NZ Police have pressured Brian, offering to drop all charges against his wife Hannah and two others from The Freedoms & Rights Coalition team in exchange for Brian’s guilty plea. Yet, he denies ‘intentionally’ breaching any COVID-19 orders. He also holds firm to his position that the NZ Bill of Rights is supreme over any COVID-19-related law.
The COVID charges against Brian!
It’s unbelievable that three years on Brian Tamaki still faces four charges of ‘intentionally’ failing to comply with COVID-19 orders.
1 x organising and 1 x attending a protest at Auckland Domain on 2 October 2021
1 x attending a protest at Auckland Domain on 16 October 2021
1 x attending a protest at Auckland Domain on 20 November 2021
The organising charge is a fine-only offence of $1,000. However, the 3 attending charges each carry a maximum sentence of six months imprisonment or $4,000 fine.
When it comes to intention, the police will have to prove Brian fully understood the COVID-19 orders that were changing almost daily from Jacinda’s podium of truth and that he intended to break them.
Also, in good faith, Brian discussed his protest plans with NZ Top Cops Andy Coster and Wally Haumaha, who reinforced his right to protest and told him not to worry about social distancing but to focus on encouraging the crowd to wear a mask.
Brian’s Courage Embolden others!
During COVID, when fear and fatigue were rampant, Brian's bravery to stand up and proclaim a message of hope—declaring he was anti-lockdowns, anti-mandates, and anti-control—inspired many others. As a result of the initial protests organized by The Freedoms & Rights Coalition, numerous support and advocacy groups emerged, helping New Zealand navigate through some of its darkest and most challenging days.
Driven by his genuine care and concern for others, demonstrated through 40 years of ongoing service transforming many of society's worst nightmares, during COVID Brian stepped up again on behalf of the people to provide a safe and responsible outlet for Aucklanders’ pent-up frustrations.
Let’s not forget, that this same dedication led Brian to mobilise masses of volunteers to assist in the aftermath of Cyclone Gabrielle in the Hawkes Bay and Gisborne regions.
We sincerely hope that anyone questioning Brian’s intentions or motives has a record of community service that surpasses his.
Do our rights matter in an emergency?
Brian firmly believes that our NZ Bill of Rights still apply, even during emergencies. This includes the right to protest, freedom of expression, and freedom of movement. While top cops, Jacinda, and judges have repeatedly affirmed his right to protest, their actions and ridicule have contradicted this principle.
'Free Speech is not a crime,' asserts Tamaki.
Jacinda’s Legacy of Control
Let us never forget the control and deception Jacinda spun during COVID.
Jacinda promised she would never mandate vaccines… yet she went on to mandate them.
She claimed that COVID would hunt down the unvaccinated… but it ended up affecting everyone, proving that the vaccine offered no protection against contracting the virus.
Jacinda declared that they were the single source of truth… but much of what they asserted has since been shown to be incorrect and inaccurate.
Brian was the first to publicly and effectively challenge Jacinda in the public domain. This made him a marked man.
COVID exposed the god-complex of many politicians, who enacted laws overnight under the guise of urgency and secrecy, granting themselves the power to intrude into our homes and families. Politicians revealed their true colours as dictators and tyrants, causing New Zealand’s COVID response ranking to plummet from 1st place in 2020 to 39th place in 2021.
Are we now living in a time when those who dare to question politicians and challenge their authority face political prosecution, such as what Brian faces now?
Keep politics out of policing!
The rapid shift from Top Cops thanking Brian for organising a peaceful protest to charging him raises serious concerns about political interference in NZ policing. Influenced by politicians and public opinion polls, the police felt pressured to pursue Brian, even though many other protesters went uncharged during the COVID years.
Let’s not forget at the time of Brian’s arrests Mark Mitchell and Simeon Brown had plenty to say too:
“Does the Prime Minister support the actions of Brian Tamaki, who is encouraging people to break the law by protesting during a pandemic?” – Simeon Brown’s question to Prime Minister Jacinda Ardern in Parliament.
“What actions has the Minister taken to ensure that the police enforce the law in relation to the unlawful gathering that Brian Tamaki has called?” - Simeon Brown’s written question in Parliament to Minister of Police, Poto Williams.
“What is the Government’s response to the actions of Brian Tamaki in relation to the COVID-19 restrictions?” - Mark Mitchell’s written question in Parliament to Minister of Police, Poto Williams.
Stop wasting Police resources. Stop targeting Tamaki.
Instead of focusing police efforts and resources on politically targeting Tamaki, NZ Police need to focus on serious crimes affecting our communities...the bus stabbings, street shootings, murders, ramraids, family harm, assaults, burglaries and more. Many of these crimes result in no more than a slap on the wrist.
In an era where Prime Minister Chris Luxon’s team and Minister of Police Mark Mitchell are talking about budget cuts and pressuring the Police Commissioner to make staff redundant, it’s astonishing that they would still pursue the costly ten-day trial against Brian and others. What is the total cost of this trial? How many police salaries could be saved by ending this senseless political exercise?
The NZ Police's ego appears to be so inflated that they are relentless in their pursuit of multiple convictions against Brian.
Fortunately for Brian and his team, they have the expert representation of Ron Mansfield KC, known for his love of a good legal fight, along with a skilled legal support team that includes familiar faces such as Sue Grey.
